Ipsos inCompass Mobile App Terms and Conditions of Use

By installing this App, you are agreeing to:

• Informing any other users of the device about this App.
• Having obtained the consent of any other users of the device on which this App is installed to these Terms.
• Ipsos collecting your location together with information about your device and how you use it for the purposes of its research (see below);
• Ipsos inviting you to complete short questionnaires or fill in diaries presented to you within the App and
• These terms of use (“Terms”).

IF YOU DO NOT AGREE, PLEASE EXIT NOW. If you no longer wish to take part in our research, you can uninstall the App at any time. More information about the App and how to install or remove the App from your mobile device can be found here.

Information collected by the App:
The Information automatically collected by the App includes:

• Your telephone number (where applicable).
• Information about the mobile device, together with information about that device such as when and for how long you charged, how much battery power is left, whether it is switched on or off and when the screen is locked or the device is active. The information about the device includes make, model, operating system (e.g. iOS, Android) and version.
• The date, time and duration of any calls made or received on the mobile device; together with the date and time any text messages are sent.
• How much time is spend browsing the internet on the device, the websites visited, if you used a link in another site or app to get to that website and the terms of any search you carry out. Please note, this may include the URL of any secure sites (https) you may visit and any search terms entered into them.
• The amount of data sent or received by your device during each data collection period
• Information about which mobile network(s) you connect to, the locations of the mobile network sign tower used to connect, together with details of any Wi-Fi connections you use, signal strength and at what times you connect and use them.
• Information about all the other apps installed on your device; including the app name, maker, when you download or remove an app, how often you use them and how long for. How much data is sent or received by each active app
• The title, name and artist of any music you may listen to; together with the date, time and duration spent listening to that music.
• Information we may deduce from combining the above information: e.g. what apps you were using just before you searched for particular information using the device's internet browser, or how often you call, email or text a particular contact.

The App does NOT record calls, nor does it collect the content of text messages or emails.

The App will also collect any information you provide when you complete a survey or diary using the App, together with any photos or video footage you take when prompted by the App. Full details of the information collected and how it will be used can be found in the App privacy policy here.

This App has been made available to you by Ipsos MORI UK Ltd, on behalf of the Ipsos worldwide group of market research companies. The registered address is 3 Thomas More Square, London E1W 1YW, UK and it is registered in England and Wales under number 01860855. Ipsos is a Company Partner member of the UK Market Research Society and complies with the Society's code of conduct.

Costs

The App is made available to you for free; however, the App sends small amounts of data over the internet at intervals. Depending on how your network provider charges you for data use, you may be charged by your network provider when the App connects to the internet.

Ownership of the App:

The App remains the property of Ipsos and our partner, Reality Mine. You must NOT make copies of the App, give it to someone else, or try to sell it, make it available for other people to use or distribute it in any other way. You must not remove or attempt to alter any copyright, proprietary or legal notices contained within the App. Nor are you permitted to attempt to decompile, reverse engineer or attempt to modify the App in any way.

You can only use it on your own personal mobile device. If someone else owns the device, or pays the bills for the device, you must have permission from the owner or person who pays the bills BEFORE you install it.

Warranties and Liability

The App and all content, functionality and features within it are provided "as is" and without warranties or representations of any kind either expressed or implied. To the greatest extent permitted by law, Ipsos disclaims all warranties of satisfactory quality and fitness for a particular purpose and that content, information displayed in or on the App is accurate, complete up-to-date and/or does not infringe the rights of any third party.

While we use reasonable efforts to ensure that the App is free from viruses and other malicious code, neither we nor any other party involved in producing or delivering the Apps assumes any responsibility, or liability for any viruses or other malicious code that may infect your Passively device as a result of downloading, installing or using the App. Except where required by applicable law, Ipsos shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful code that they access from or via the App.

Save in respect of any liability for personal injury or death caused by our negligence, Ipsos shall not be liable for any damages, loss or injury arising in connection with these Terms and/or your use of, or the inability to use, the Apps, or any function of the Apps, howsoever caused.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
