Ipsos MediaCell+ App Terms and Conditions of Use

By installing this App you are agreeing to:

• Ipsos collecting your location together with information about your device, how you use it and any TV and radio stations the App may detect audibly via your device for the purposes of its research; and
• These Terms of Use.

Information collected by the App:
The Information collected by the App includes:

• Your location.
• Your phone number, email address and the unique advertiser ID associated with your device (e.g. Android Advertiser ID or App IDFA).
• A unique code for each TV or radio station audible to your device, together with a code generated from any sound that may be a TV or radio station that is audible to your device, even when you are not using it.
• Information about your device (including IMEI or UID number, if it is moving, in sleep mode etc.).
• Information about the other apps on your device, including, the names of all apps installed.
• Information about network connections your device uses to connect to the internet (including IP addresses, WiFi networks etc.)
• Information indicating how often you use your device (including when you make or receive a call, or send or receive a text/MMS message). Please note the App does NOT record calls, nor does it collect the content of text messages
• How much time you spend browsing the internet on your mobile device, the websites you visit, including the website name (e.g. Google.co.uk), how it was accessed (e.g. you navigated to it, redirected to it by a webpage or you clicked on a hyperlink) and date and time you visit each site.
• Total amount of data received or sent by your device.
• What music tracks you may listen to using your device.

App provider:

This App has been made available to you by Ipsos MORI UK Ltd for and on behalf of the Ipsos worldwide group of research companies. Ipsos MORI UK Ltd.’s registered address is 3 Thomas More Square, London E1W 1YW, UK.

Costs

The App is made available to you for free; however, the App sends small amounts of data over the internet at intervals – this equates to approximately 13 mb per day (an average mp3 music file is 3mb). Depending on how your network provider charges you for data use, you may be charged by your network provider when the App connects to the internet.

Ownership of the App:

The App remains the property of Ipsos. You must NOT make copies of the App, give it to someone else, or try to sell it, make it available for other people to use or distribute it in any other way. You must not remove or attempt to alter any copyright, proprietary or legal notices contained within the App. Nor are you permitted to attempt to decompile, reverse engineer or attempt to modify the App in any way.

You can only use it on your own personal mobile device. If someone else owns the device, or pays the bills for the device, you must have permission from the owner or person who pays the bills BEFORE you install it.

Warranties and Liability

The App and all content, functionality and features within it are provided "as is" and without warranties or representations of any kind either expressed or implied. To the greatest extent permitted by law, Ipsos disclaims all warranties of satisfactory quality and fitness for a particular purpose and that content, information displayed in or on the App is accurate, complete up-to-date and/or does not infringe the rights of any third party.

While we use reasonable efforts to ensure that the App is free from viruses and other malicious code, neither we nor any other party involved in producing or delivering the Apps assumes any responsibility, or liability for any viruses or other malicious code that may infect your device passively as a result of downloading, installing or using the App. Except where required by applicable law, Ipsos shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful code that they access from or via the App.

Save in respect of any liability for personal injury or death caused by our negligence, Ipsos shall not be liable for any damages, loss or injury arising in connection with these Terms and/or your use of, or the inability to use, the Apps, or any function of the Apps, howsoever caused.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
